GoCash Daily Giveaway OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED.
1. GIVEAWAY TERM AND DEADLINES: GoCash Daily Giveaway ("Giveaway") begins Novemer 9, 2009 at 12:00:01 a.m. (Pacific Time ["PT"]) and ends December 9, 2009 at 11:59:59 p.m. PT ("Giveaway Period"). One Random Drawing will be held for each day beginning November 9th, 2009 and ending December 9, 2009. Each daily Random Drawing will be held from among all eligible entries received as of 11:59:59 on that day. Each daily Random Drawing will be held on the following day. For example the Random Drawing for November 9, 2009 will be held on November 10, 2009 from among all eligible entries received as of 11:59:59 p.m on November 9, 2009. Giveaway Administrator's computer is the official time clock for the Giveaway. Proof of submission will not be considered proof of receipt. Winners will be notified on or before December 14, 2009. Once we notify the winner, all the winner must confirm that they got notified and need to submit their agreement and required information by January 14th, 2009.
2. ELIGIBILITY: The Giveaway is open and offered only to GoCash members in good standing who have successfully registered for GoCash as set forth on https://www.gocashgamecard.com/member/join and who are legal residents of the 50 United States and the District of Columbia (excluding Puerto Rico), and 17 years of age or older at the time of entry. If you are not a GoCash program member, you may join online at https://www.gocashgamecard.com/giveaway. GoCash membership is subject to GoCash Members Rules. Giveaway is void in Puerto Rico, U.S. territories and possessions outside the 50 United States and District of Columbia, and where prohibited or restricted by law. Employees and directors of G10 VMS INC., ("Sponsor"), and their respective parent, affiliated companies and subsidiary companies, and their advertising, promotion, or production agencies, prize providers, Web masters and Web suppliers, and any companies who are performing work in G10 VMS office at the request of G10 VMS, and their respective officers, directors, employees, representatives and agents, (collectively, the "Giveaway Entities"), and their IRS dependents, immediate families (parent, child, sibling and spouse) and/or members of their households, are ineligible to participate in this Giveaway. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to this Giveaway.
3. TO ENTER: Log on to http://www.gocashgamecard.com/events/event_view.aspx?id=13 (the "Giveaway Website") and click on the icon to access the Entry Form. You must enter your Go Cash Membership I.D. and password and follow the online instructions to submit one (1) ("Entry"). Limit of one (1) Entry per Go Cash member I.D. per day. If you have forgotten your Go Cash member I.D. number or password, you may request ID and Password online. Proof of submission is not proof of receipt. Any attempt at e-mail or other method of entry is void. Any attempt by any person to obtain more than the stated number of Entries by using multiple/different email accounts, or any other methods will void all of that person's Entries and that person will be disqualified.
4. DRAWING: Winners will be selected during Random Drawings to be held each day beginning November 9th, 2009 and ending December 9, 2009. Each day's Random Drawing will be held on the following day from among all eligible Entries received as of 11:59:59 p.m on the previous day. Non-winning Entries for each day's Random Drawing will roll over into subsequent day's Random Drawing. Random Drawing will be conducted by Sponsor or its designee, whose decisions are final on all matters relating to the Giveaway. Prize winners will be notified via mail, email, telephone and/or overnight courier at the address/email address on file with the Go Cash on or before December 14th , 2009. Odds of winning each day's Random Drawing depend on the number of eligible Entries received for that day's Random Drawing. One prize per person or household during the Giveaway. Example. Xbox winners are not eligible to re-enter to win any other prizes. As for the bonus cash, promotion period and bonus cash rate may vary.
5. PRIZES: Eight Hundred and Six (806) Prizes, each consisting of Thirty-One (31) XBOX 360 Pro Console, ARV $299.99 Each; One Hundred fifty-five (155) $50 GameStop Gift Cards; Six Hundred Twenty (620) $15 Go Cash Game Card, Total ARV of all Prizes: $26,349.69.
Winners may not substitute, assign or transfer prize, or redeem prize for cash, but Sponsor reserves the right, in its sole discretion to substitute any prize with another prize of equal or greater value should an advertised prize become unavailable for any reason. Prize consists of only those items specifically listed as part of the prize. Prizes will not be fulfilled outside the United States. All other expenses not specified herein are the responsibility of the winner. All taxes are the sole responsibility of winner.
6. CONDITIONS OF PARTICIPATION: Entrants agree (a) that Sponsor and its parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, and Giveaway Entities will have no liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Giveaway or any Giveaway related activity, or for any printing, production, typographical, human or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winner, or if winner is deemed a minor in his or her jurisdiction of residence, such winner's parent or legal guardian, grants (and agrees to confirm such grant in writing) permission for Sponsor and those acting under its authority to use winner's name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the World Wide Web, without notice, review or approval. By participating in this Giveaway, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information pursuant to Sponsor's privacy policy available on-line at www.gocashgamecard.com.
7. LIMITATIONS ON LIABILITY: Automated Entries, or Entries sent by robotic means or macro, are not allowed and will be disqualified. Persons who tamper with or abuse any aspect of the Giveaway, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant's eligibility. Sponsor is not responsible for outdated or incorrect Go Cash membership data. In the event of a dispute as to ownership of a winning Entry, the owner of the Go Cash membership card used to enter online, as indicated in Sponsor's records, will be deemed the winner. Should any portion of the Giveaway be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Giveaway and select winners from all eligible Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Giveaway Site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, technical failure, theft or destruction, or unauthorized use in connection with the purchase transaction entry portion or any other portion of the Giveaway.
IN NO EVENT WILL SPONSOR, ITS PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, ITS RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR ANY OF ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, AND GIVEAWAY ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE GIVEAWAY SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.GOCASHGAMECARD.COM OR ANY OTHER WEBSITE ASSOCIATED WITH THIS GIVEAWAY. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE GIVEAWAY SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 8. CHOICE OF LAW: Any and all legal actions or claims arising in connection with this Giveaway must be brought in a court of competent jurisdiction in Los Angeles, California. Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California law, without reference to California choice of law rules, governs the Giveaway and all aspects related thereto.
9. Please specify "Rules" or "Winners List". VT residents may omit return postage. Winners list available December 15, 2009. Limit one (1) rules request and one (1) winner's list request per person/household.
